The following types can be registered: Credit Cooperative Societies, Housing Cooperative Societies, Agriculture Cooperative Societies, Workers/Labour Cooperative Societies, Consumer Cooperative Societies, Producer Cooperative Societies, Marketing Cooperative Societies, and other multi-purpose cooperatives.
Is a credit cooperative society legal under the MSCS Act?
+
Yes. Credit cooperative societies are specifically recognised under the MSCS Act, 2002. They can accept deposits from and provide loans to their members. How often must board elections be held?
+
Board elections for a multi-state cooperative society must be conducted every 5 years as per the MSCS Act, 2002 (amended 2022). The elections must be conducted by the State Cooperative Election Authority or as per the society's bye-laws. We provide complete election management services.
Can a multi-state cooperative society open branches?
+
Yes, a multi-state cooperative society can open branches in any state across India. Branches must be registered with the respective state government and comply with local regulations. The head office must inform the Central Registrar of branch openings.
What is the difference between a Nidhi company and a credit cooperative?
+
A Nidhi company is registered under the Companies Act and regulated by MCA/RBI. A credit cooperative society is registered under the MSCS Act (or State Act) and regulated by the Registrar of Cooperative Societies. Cooperatives are member-owned, democratically governed, and operate on the principle of service to members — not profit maximisation.
Can foreigners or NRIs be members of a multi-state cooperative?
+
As per the MSCS Act, membership is generally restricted to Indian citizens. NRIs may be admitted as nominal or associate members in some cases, depending on the bye-laws of the specific society. Foreigners are generally not permitted to be members.
What happens if annual returns are not filed on time?
+
Failure to file annual returns can result in penalties, show-cause notices from the Central Registrar, and in serious cases, cancellation of registration. It is critical to maintain timely compliance. We offer annual compliance retainer services to prevent such situations.
Can a multi-state cooperative society be dissolved?
+
Yes, a multi-state cooperative society can be dissolved voluntarily by a special resolution of members, or compulsorily by an order of the Central Registrar under Section 77 of the MSCS Act for reasons such as failure to comply with the Act, insolvency, or reduction in membership below the minimum prescribed.
Do you provide services for existing societies that need help with compliance?
+
